Grais & Ellsworth Protects Rights of Teenager with Pro Bono Win in the First Department

In collaboration with Lawyers for Children, Grais & Ellsworth served as pro bono counsel for a sixteen-year-old in an appeal to the New York Appellate Division, First Department. The Family Court had found that Eriq W. willfully violated a Family Court order of protection issued on behalf of his daughter and sentenced him to six months in prison. Eriq W. appealed the Family Court’s order, claiming that defects in the violation petition deprived Family Court of jurisdiction and violated his right to due process. The First Department ruled in favor of our client and unanimously confirmed the Family Court’s order.

Grais & Ellsworth LLP formed team G&E for the cure! and came together on Saturday, September 10, 2016, to support Susan G. Komen’s fight against breast cancer by competing in the 5K Race for the Cure through Central Park. Leading up to the race, team members worked hard to raise money for donations and the firm generously matched all of them with the team raising close to $13,000! Thanks to all of the race participants and to our supporters for making this a successful event.

Following the court’s decision to grant the relief we requested for our client, an inmate incarcerated at Attica Correctional Facility, Grais & Ellsworth filed a motion for attorney’s fees that was granted in part. The proceeds will be donated to the organization that referred the case, the Prisoners’ Legal Services of New York.

Grais & Ellsworth represents an inmate incarcerated at Attica Correctional Facility in a judicial challenge to a prison disciplinary proceeding that imposed a term of solitary confinement, loss of good-time credit, and suspension of privileges. After filing an Article 78 challenge to the disciplinary proceeding, in April 2016, the court held that our client was denied his right to call witnesses in his defense and his right to meaningful assistance from prison staff during the disciplinary hearing. The court granted all the relief requested: our client’s disciplinary record was expunged and his good-time credits and privileges were restored.
